The Case

Sentence Imprisonment. A total sentence of 12 months' imprisonment, comprising three consecutive sentences of four months' imprisonment, which had been imposed on a defendant who had been committed to the Crown Court for sentence after she had pleaded guilty, inter alia, to three summary offences of driving whilst disqualified, was unlawful. The maximum sentence should have been six months' imprisonment, being the maximum sentence permitted in the magistrates' court on summary offences. Accordingly, the appropriate sentence in respect of each offence of driving whilst disqualified was two months' imprisonment.
