The Case
Contract Damages for breach. In the instant case, where the defendant had entered into a compromise agreement with the claimant agreeing to use its best endeavours to secure payment to the defendant of his lump sum pension payment, that agreement had extended to all aspects of the defendant's pension arising out of his employment with the defendant.
