On the defendant's appeal against a sentence of 12 months' imprisonment in a young offender institution for racially aggravated common assault, the sentence was reduced to six months' imprisonment in a young offender institution in circumstances where the sentencing judge had overlooked well established dicta and the relevant guidelines.
