The Case
Sentence Custodial sentence. A sentence of three years' imprisonment for an offence of conspiracy to steal 9,000 of power tools, which was to run consecutively with a four-year term that had been imposed on an earlier occasion was excessive in circumstances where a co-accused had received a community-based sentence. Accordingly, a sentence of 18 months' imprisonment would be substituted, to run consecutively with the four-year term, giving a total sentence of five and a half years' imprisonment.
