European community - European Court of Justice - Jurisdiction - Reference to European Court of Justice - Whether Court having jurisdiction to answer questions referred for preliminary ruling where facts of case having occurred prior to accession of state to European Union.
In circumstances such as those of the dispute in the instant case, the facts of which had occurred prior to the accession of a state to the European Union, the Court of Justice of the European Communities did not have jurisdiction to answer the questions referred for preliminary ruling.
