The Case

The court set the offender's minimum term for the murder of another alcoholic, committed in the course of a drunken fight in which he stabbed the deceased multiple times, at 14 years' imprisonment, less time spent in custody on remand. Although the starting point under the would have been 15 years' imprisonment, the court could not set a minimum term greater than that which the Secretary of State would have been likely to notify under his former practice.
