Drugs - Drug trafficking - Confiscation order - Defendant buying house two years after confiscation order made - Judge increasing amount to be recovered under confiscation order - Whether judge erring in exercise of discretion.
The Crown Court's discretion under s16 of the to increase the amount to be recovered under a confiscation order was unfettered. A judge could have regard to matters, or reject them as of little significance. It depended on the circumstances of the individual case.
