The Case
Conditions of a discretionary loan offered by the local authority to facilitate, in the light of the claimant's disabilities, his continued occupation of the family home on a long-term basis, which conditions provided, inter alia, for repayment of the loan if he ceased to reside there during a period of 20 years, were reasonable.
