Injunctions - Interim injunction - Injunction to prevent infringement of patent - Enquiry on cross-undertaking - Entitlement of non-party to recover losses arising from injunction - Direction for preliminary issue.
Preliminary issues would be directed in order to determine questions arising in the course of proceedings, where as applications under CPR3.4 were intended to strike out unarguable contentions, and should be approached differently.
