The Case
On an application pursuant to CPR19.2, SI1998-3132, to join eight further defendants as parties to the instant proceedings, the court held that it was appropriate to join all persons with an interest in the right of way at issue and whose interests were affected by the declarative relief sought. Accordingly, the application would be allowed.
