The Case
The Lord Chief Justice handed down a practice direction to amend, by replacement of PtIV.41 and addition to PtV of, the consolidated criminal practice direction handed down on 8 July 2002 (see ). In particular, it sets out forms to be used under r3.11(1) of the Criminal Procedure Rules 2005, SI2005-384. The practice direction was to take effect from 4 April 2005, when the Criminal Procedure Rules 2005, SI2005-384, come into force. It applied to the sending, committal or transfer of cases by magistrates' courts to the Crown Court for trial where that event takes place on or after that date, and to the subsequent management of those cases in the Crown Court.
