Negligence - Duty of care - Tour operator - Swimming pool accident - Liability.
On the evidence, the claimant had not established liability on the part of the defendant in respect of an accident whereby he fell into a shallow swimming pool whilst under the influence of alcohol and sustained a very serious injury to his cervical spine rendering him tetraplegic.
