Negligence - Personal injury action - Accident at work - Building site - Claimant falling off ladder - Statutory duty - Liability.
Where the claimant had fallen from a ladder whilst at work, and a trainee employed by the defendant had not been footing the ladder, on the evidence, the trainee had been negligent and in breach of statutory duty under the Construction (Health, Safety and Welfare) Regulations 1996, SI1996-1592, and the defendant employee was vicariously liable for those breaches.
