The Case
On an application by the claimant for, inter alia, summary judgement against the first, second and third defendants in proceedings in which the claimant sought to recover monies paid into those defendants' bank accounts, the court held that, in all the circumstances, it was highly probable that all of the monies in the accounts belonged directly to the claimant and would accordingly grant the orders sought.
