The Case
In the instant case the claimant company obtained an interim injunction which, inter alia, restrained the defendant company from publishing images on a website which the claimant had identified as copyright, as, on the evidence before the court, the claimant had satisfied the relevant test and was in a financial position to offer a cross-undertaking in damages.
