European Communities - Right of establishment - Companies - Banking - National prohibition on payment of interest on sight accounts - Purported justification on basis of consumer protection and encouragement of medium and long-term saving - Article 43 EC.
Article 43EC precluded legislation of a member state which prohibited a credit institution which was a subsidiary of a company from another member state from remunerating sight accounts in euros opened by residents of the former member state.
