The Case
On an appeal from the dismissal by the employment tribunal of the employee's complaint that he had suffered detriment as a result of victimisation, the Employment Appeal Tribunal held that the tribunal had failed properly to direct itself. Accordingly, the decision of the tribunal would be quashed and the issue of detriment would be remitted for hearing by a differently-constituted employment tribunal.
