Sentencing - Indecent assault - Custodial sentence - Suspended sentence not appropriate.
The Case
Where the 80-year-old defendant was sentenced to a total sentence of 18 months' imprisonment, in concurrent terms, following his conviction for two offences of indecent assault on his grandsons when they were between the ages of six and eight, it was not a case where the court should be persuaded to suspend the sentence. Accordingly, the defendant's appeal would be dismissed.
