The Case
Having regard to Regulation4 of the Motor Cycles (Protective Helmets) Regulations 1998, , even if a defendant was in the safety cell or covered by any safety frame of a motorcycle, he would still be the driver of the motorcycle and subject to the requirement to wear the specified protective headgear.
