The defendant was charged with and pleaded guilty to an offence of facilitating the unlawful immigration of another to a member state contrary to s25(1) of the . The judge had been entitled on the facts to conclude that the defendant had been involved in some form or professional scheme and on that basis a sentence of two years' imprisonment, despite a plea of guilty, had been unimpeachable.
