The Case
In the instant case the reference made by the French court under art234 EC concerning the classification of pen cases imported by the claimant into the European Union, and in particular to plastic coatings on such products, did not reveal any information such as to affect the validity of the 'explanatory notes to the combined nomenclature of the European Communities' relating to subheadings 4202 12 11 and 4202 12 19.
