The Case
Article1(2) of Commission Decision (EC) 2003-382 (relating to a procedure under art81 EC concerning seamless steel tubes) would be annulled in so far as it found that the infringement imputed to the applicant by that provision existed before 1 January 1991, and the fine imposed on the applicant under art4 of the decision would, accordingly, be reduced.
