The Case
The employee's conduct in past litigation combined with his failure to comply with the directions clearly demonstrated that he would continue to refuse to comply with any future practice directions made. Accordingly, pursuant to rule26 of the Employment Appeal Tribunal Rules 1993, the employee would be debarred from taking further steps in his appeal.
