Contracts - Novation - Consent to novation - Finance agreement to accelerate trade receipts not giving rise to novation of underlying contract.
In all the circumstances, there was no contractual relationship between the claimant and the defendant since there had been no novation of the contract for maintenance at the defendant's premises when the contractor had entered into a finance agreement with the claimant finance company.
