The Case
In the circumstances of the instant case, the court was satisfied that it was appropriate to make an order for costs in the applicant's favour but which also highlighted the fact that fabrication of documents would be reflected in costs, particularly in the instant case in which the unwillingness to negotiate was inappropriate.
