Costs - Order for costs - Costs following the event - Only one of several claims successful on appeal - Appropriate order for costs.
The Case
Where the claimant had been successful in relation to one issue on appeal, but had lost in respect of another, it would not be appropriate for it to be awarded all of its costs of the appeals. The proper order for costs would therefore be that the first defendant pay 50% of the claimant's costs of the appeals.
