The Case
Where an originating application had been made stating all the grounds claimed in an action, a party could allege additional grounds without successfully gaining permission to amend once proceedings have commenced. Where the additional grounds were out of time, the court had a discretion to refuse amendment where it would inequitable to permit such claims to proceed.
