The Case
The claimant's application for summary judgment, under CPRPt24, in its claim for passing off made against the defendant and for the transfer of the defendant's web sites domain name was allowed on the basis that the web sites had been created with the intention of deceiving the public and that the matters raised by the defendant were not a defence to the claim for passing off.
