The Case
The European Court of Justice dealt with questions concerning the validity of a bilateral treaty negotiated between Austria and the Czech Republic prior to the accession of Austria; in particular, the effect of arts28 and 307 EC and Council Regulation (EEC) 2081-92 (which provided rules for Community protection of designations of origin and of geographical indications of agricultural products and foodstuffs), in the context of a trademark dispute between beer importers.
