Catchwords

Solicitors - Law Society - Professional services - Services not of quality reasonably to be expected of solicitor - Solicitor and former client compromising client's complaints - Solicitor breaking terms of compromise - Jurisdiction of Law Society to take steps in relation to renewed complaint against solicitor - Amount of compensation to be paid by solicitor -  1A, para 1.

The Case

An agreement with a former client to compromise his complaint against a solicitor was a matter within para1(1) of Sch1A to the in respect of which the Law Society could take steps under para2. There was manifestly no room for a purely punitive element in an award under Sch1A, but equally plainly there was room for what at common law would be aggravated damages, ie compensation which reflected not only the stress and inconvenience caused by the misconduct but its persistence and contumacity.
