Companies - Director - Breach of fiduciary duty - Recovery of losses - Reflective losses.
On the determination of two preliminary issues, the court ruled that although the defendant as a director of BDCplc had been in breach of his pleaded fiduciary duties, the claimant's claims were barred on the basis that the claims were based on reflective losses and, accordingly, the action was dismissed.
