The Case
The European Court of Justice found Finland in breach of its obligations under Council Directive (EC) 89-105 (on the transparency of measures regulating the prices of medicinal products for human use and their inclusion in the scope of national health insurance systems) in respect of one complaint brought by the European Commission, relating to the decision of Finland's commission for medicine prices establishing the categories of medicinal products subject to higher-rate cover.
