Civil evidence - Disclosure of documents - Subsequent use of disclosed documents - Restriction or prohibition on use of document which has been disclosed - CPR 31.22(2).
The Case
Although the judge had been right to make an order under CPR31.22(2) prohibiting indefinitely the use in proceedings of documents belonging to a third party, it had been open to him to allow the use of the documents in particular proceedings on terms that they would be dealt with in private, and he should have done so.
