The Case
Where work was undertaken under s23(1)(b) of the Housing, Grants, Construction and Regeneration Act 1996, the relevant works had to be intended to make the dwelling safe for the disabled person. If the premises was already safe for him and the purpose of the works was for the benefit of those residing with him, that section did not apply.
