Catchwords

Costs - Assessments of costs - Copyright infringement - Appeal against order of costs judge - Meaning of 'costs of the trial commencing on' in costs order - Construction of order.

The Case

The claimants' appeal against a decision of the costs judge deciding that the meaning of 'costs of the trial commencing on ' included the entirety of the brief fees, was allowed on the grounds that those words had to be looked at in the context of the costs order as a whole, and the costs judge had given too little weight to the other aspects of the order and the relevant judgment.
