The Case
In dismissing an application by a defendant for, inter alia, a declaration that the court should decline jurisdiction in favour of Chilean courts, notwithstanding a non-exclusive jurisdiction clause, the Commercial Court reviewed the authorities on the enforceability of such clauses.
