The Case
The Employment Appeal Tribunal upheld the employment tribunal's decision that the trust had unfairly and wrongfully dismissed the employee. It also affirmed the decision that the trust, and the second and third appellants, who were the employee's superiors, had unlawfully discriminated against the employee on racial grounds as it could not be said that the tribunal's findings were such that no reasonable tribunal could have made them.
