Catchwords
Sentencing - Custodial sentence - Duration - Indecent assault - Community rehabilitation order as alternative to custodial sentence - Consideration of relevant facts.
The Case
The defendant's appeal against a sentence of fifteen months' imprisonment for indecent assault was quashed and substituted by a community rehabilitation order of three years on the grounds that, in the circumstances, such an order was more appropriate than a custodial sentence since it would help the defendant get support to deal with her problems and hopefully get her reunited with her family.
