The Case
In order to give effect to the judge's expressed intention to impose marginally longer sentences on the defendant's co-accused in a charge of assault occasioning actual bodily harm, to reflect the fact that they committed the assault whilst on licence, the defendant's sentence would be reduced from two years' imprisonment to 18 months' imprisonment.
