The Case
The Employment Appeal Tribunal allowed the employer's appeal against an employment tribunal's finding of unlawful victimisation on the ground that the employee was not such a victim under of the Race Relations Act 1976, but dismissed the employee's cross-appeal which alleged bias and perversity on the part of the tribunal.
