The Case
Where the Secretary of State issued a notice under s25(2) of the setting out the qualifications required of the person in charge of the home, he had power, where that person was a registered nurse, to incorporate those requirements into a notice issued under s25(3). Furthermore, on its true construction, s29(4) of the provided a criminal sanction for breach of the conditions contained in such a notice.
