The Case
The failure of a local planning authority on the claimant's appeal, against its decision to issue an enforcement notice, to disclose to the inspector documents supplied to it by the claimant in support of his case did not vitiate the inspector's decision since the documents in question had been retained by the claimant. An analogy with disclosure by the prosecution in criminal proceedings was not apt.
