The Case
The defendant's appeal against a sentence of five years' detention in a young offender's institution and disqualification for driving for ten years for causing death by dangerous driving would be allowed where the maximum sentence for that offence was ten years' imprisonment, and many of the usual aggravating features such as the consumption of alcohol or driving at excessive speed were not present.
