The Case
The Court of Justice of the European Communities declared that the Netherlands had failed to fulfil its obligations under Council Directive (EC) 97-70 (setting up a harmonised safety regime for fishing vessels of 24 metres in length and over) by failing to adopt, within the prescribed period, the laws, regulations and administrative measures necessary to comply with that directive.
