The Case
On the facts, the applicant had failed to provide sufficient particulars to support his allegations against the respondent solicitors. Moreover, his claim against the solicitors, as legal representatives of claimants in previous proceedings against him, required the revival of the original proceedings in order to pursue a claim against the respondent as agent. In the circumstances, it was wrong to allow a claim which had been struck out as abusive to be revived in that way.
