Catchwords
Employment - Contract of service - Termination - Applicant employed under fixed term contract - Contract not renewed at end of term - Whether applicant unfairly or wrongly dismissed - Whether dismissal due to end of contract - s 197(1).
The Case
The existence of another reason which entitled an employer not to offer a renewal of a fixed term contract, did not have the effect of making the dismissal consist otherwise than only of the expiry of the term. On the proper construction of the terms of the contract in the instant case, there was a fixed contract which prevented the applicant from complaining of unfair dismissal.
