Catchwords
Family proceedings - Costs - Practice - Costs reserved - Whether hearings longer than one day should be subject to detailed assessment - CPR 44.7.
The Case
On a proper construction of the Civil Procedure Rules there was a move towards summary assessment, even for the costs of longer hearings, since the exercise of the power to make a summary assessment now had to be considered in every case. Had there been a general rule to the contrary the rules would have said so.
