The Case
On an application for an interim payment in proceedings by which the claimants sought damages for conspiracy, the court was satisfied on the evidence that, if the case went to trial, the claimant would obtain judgment for a substantial amount of money against the defendant from whom he sought the order for an interim payment pursuant to CPR25.7(1)(c) and accordingly allowed the application.
