Employment tribunal - Remuneration - Deduction from wages - Appellant employer paying respondent employees for additional hours - Employer subsequently paying employees for bonus only - Employees claiming unlawful wage deduction - Employment tribunal deciding employees legally entitled to bonus - Whether tribunal erring in law.
The Case
An employment tribunal's decision that employees paid over a period of time for extra hours not actually worked had a legal entitlement to that sum, and that a subsequent bonus had acquired similar status, could not be justified on the facts. Accordingly, the tribunal's decision reflected errors of law, and as there had been no unlawful deduction of wages, the employer's appeal would be allowed
