Catchwords
Unfair dismissal - Compensation - Calculation of award - Employee bringing unfair dismissal claim - Employment tribunal finding dismissal procedurally unfair and awarding two weeks wages for failure to consult - Employee appealing on basis that tribunal failing to make award for failure to warn of redundancy - Whether tribunal in error.
The Case
The process by which an employee was dismissed for redundancy should necessarily include a consultation process, commencing with the warning that an employee was at risk. However, there were not two separate processes, one of warning, and another separate of consultation, since the two parts were part of the same single process.
